- Lead anti-counterfeiting campaigns by:
- Working with private investigators to locate brick and mortar, e-commerce, and social media sellers of counterfeit goods;
- Pursuing claims against sellers of counterfeit products pursuant to the Lanham Act (15 U.S.C. § 1117(b),(c));
- Obtaining judgments or reaching settlement agreements which enjoin the counterfeiter from using our client’s marks and securing monetary damages; and
- Seizing and destroying counterfeit merchandise to remove them from the marketplace.
- Coordinate anti-trademark infringement campaigns by:
- Conducting online searches for retailers using our clients’ intellectual property without authorization or permission;
- Pursuing claims against trademark infringers pursuant to the Lanham Act (15 U.S.C. § 1117(a)); and
- Obtaining judgments or reaching Settlement Agreements with infringers to recover damages for our clients and prevent future infringement of the mark.
- Work with U.S. Customs and Border Patrol and international Customs and law enforcement agencies to record clients’ intellectual property rights with the appropriate authorities, train customs agents on identifying counterfeit goods, halt the importation of counterfeit goods, and, when appropriate, to investigate and conduct seizure raids, which often result in actions and identification of overseas counterfeit manufacturers.
- Provide intellectual property counseling to combat counterfeiting.
- Draft trademark license agreements, manufacturing agreements, supplier agreements, product placements agreements and logistic agreements to ensure intellectual property rights are protected from counterfeiting activities.
- Monitor and enforce clients’ intellectual property rights on online marketplaces such as Amazon, Alibaba, eBay, etc. to achieve take-downs of counterfeit and gray market products listed for sale by unauthorized sellers.
