Each member of the Bankruptcy & Creditors’ Rights Group is an accomplished bankruptcy practitioner. Members of the group are well-known and highly regarded in their field. Our attorneys are invited speakers at leading bankruptcy seminars and publish articles on current trends and developments in bankruptcy and insolvency matters. Two of our partners are board-certified in business bankruptcy law by the American Board of Certification.
How We Help
We represent creditors, debtors, trustees, and lenders in various bankruptcy and bankruptcy-related matters. In addition, we handle bankruptcy and insolvency-related litigation, as well as distressed sales and acquisitions. Attorneys in the group have appeared in bankruptcy courts in Ohio, Missouri, California, Delaware, Illinois, Indiana, Iowa, Kentucky, Michigan, Nebraska, New York, Pennsylvania, Texas, West Virginia, and the U.S. Virgin Islands. We have also handled appeals of bankruptcy matters in appellate and federal district courts throughout the country.
Although the group’s members are well-seasoned bankruptcy lawyers, we recognize that bankruptcy matters can give rise to many complicated issues that impact our clients’ strategies and decisions. In matters outside of the group’s focus, we collaborate with other firm attorneys to provide a full range of services.
We regularly represent clients in the following matters:
- Acquisitions and Sales of Distressed Companies: We have extensive experience representing clients with respect to the sale and purchase of assets inside (pursuant to a Section 363 sale or Plan of Reorganization) and outside the bankruptcy forum. We have the experience and know-how to negotiate strategic terms and conditions, assist in using structured financing techniques, and accurately and thoroughly memorialize the transaction to accomplish your objective.
- Asset Protection: We help clients and protect corporate and individual assets. We counsel clients on the proposed structure of business transactions, the titling of assets, and contract language to minimize the risk of a future insolvency of any involved party.
- Debtor and Creditors’ Rights and Remedies: We help individual and corporate debtors develop strategic plans of reorganization from a business and operational perspective. We also help secured creditors – including mechanic’s lien claimants and lending institutions – protect their rights during the bankruptcy case process. Bankruptcy trustees, unsecured creditor committees, and organizations seek our assistance when facing assignments for the benefit of creditors and issues arising under the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Uniform Commercial Code, and the WARN Act. We help clients recover value from debtors pursuant to judicial and non-judicial foreclosures on real estate, foreclosure on security interests in tangible and intangible personal property, and through the enforcement of judgment liens.
- Judgment Enforcement: We assist clients with actions to pursue asset discovery or recover value using state and federal execution processes such as garnishment, attachment, and execution.
- Loan Documentation: We assist lenders with the review of loan forms and documentation of specific transactions to maximize protections and minimize the effects of a potential bankruptcy proceeding.
- Reorganizations and Workouts: We regularly represent debtors, financial institutions, and other secured and unsecured creditors in reorganizations, restructuring and workouts, in and out of court. We counsel businesses through the renegotiation of the terms of their financing agreements and provide strategic advice to assist with reducing debt, restructuring, and/or streamlining business operations.
- UCC Secured Transactions: We help clients – whether a commercial operation or financial institution – with respect to Uniform Commercial Code matters, including secured transactions, commercial paper and negotiable instruments, sales of goods, and bulk sales.
